Terms of Service for Diecastman's Shop

Welcome to Diecastman's Shop. These Terms of Service ("Terms") govern your access to and use of Diecastman's Shop, including our website, online store, products, services, customer accounts, communications, and other features we make available (collectively, the "Services").

By accessing or using the Services, placing an order, creating an account, or otherwise interacting with Diecastman's Shop, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Services.

By accessing or using Diecastman's Shop, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy.

2. About Diecastman's Shop

Diecastman's Shop is an online retailer specializing in diecast collectibles, accessories, branded merchandise, and related products.

We reserve the right to modify, suspend, or discontinue any portion of the Services at any time, with or without notice.

Unless otherwise stated in a product listing, products are sold in the condition described on the applicable product page.

For collectible items, condition may refer to the item itself, its packaging, or both. Customers should carefully review product descriptions and photographs before purchasing.

Manufacturing imperfections, minor cosmetic variations, packaging wear, factory defects, or other characteristics inherent to collectible products may not necessarily constitute damage or a defect.

Where applicable, any specific condition grading or description provided on a product listing will control for that particular item.

5. Orders

Placing an order through Diecastman's Shop constitutes an offer to purchase the selected products.

An order confirmation does not necessarily mean that your order has been finally accepted. We reserve the right to accept, decline, cancel, or limit any order at our discretion, including after an order confirmation has been issued.

We may cancel an order if, for example:

A product is unavailable.
A pricing or product information error occurred.
We suspect fraudulent or unauthorized activity.
We believe an order is intended for unauthorized resale.
We are unable to process payment.
Shipping or billing information cannot be verified.
An order exceeds applicable quantity limits.
A technical or inventory error affects the order.

If we cancel an order after payment has been received, we will generally refund the amount paid for the canceled portion of the order.

8. Shipping and Delivery

Orders may be shipped using USPS or other shipping carriers selected by Diecastman's Shop.

Processing and delivery times may vary based on product availability, order volume, shipping method, destination, weather, carrier delays, holidays, and other circumstances outside our control.

Tracking information may be provided when available.

Once an order has been transferred to the shipping carrier, delivery times are generally controlled by the carrier. We are not responsible for carrier delays that are outside our reasonable control.

Customers are responsible for providing an accurate and complete shipping address. We are not responsible for delays, additional shipping charges, or failed delivery resulting from incorrect or incomplete information provided by the customer.

If an order is returned to us because of an incorrect or undeliverable address, additional shipping charges may apply before the order can be reshipped.

9. Lost, Stolen, or Damaged Packages

If tracking indicates that a package has been delivered but you cannot locate it, you should first check with household members, neighbors, the delivery location, and the applicable shipping carrier.

We may assist with carrier inquiries or claims where appropriate, but we cannot guarantee reimbursement for packages that are lost, stolen, or misdelivered after shipment.

If your order arrives damaged, please contact us as soon as reasonably possible and provide photographs of the shipping package and damaged product. We may require this information to evaluate a claim.

Any claims involving damaged or missing merchandise are subject to applicable carrier requirements and our return and refund policies.

10. Returns, Refunds, and Exchanges

11. Cancellations

We cannot guarantee that an order can be canceled once it has entered processing, been packed, or been shipped.

If an order cannot be canceled, it may be subject to our return policy.

If we offer preorder, backorder, special-order, or similar products, additional terms may apply to those products.

Estimated release dates and arrival dates are provided for informational purposes and may change due to manufacturer, supplier, shipping, or other circumstances outside our control.

A preorder or special-order item may not be available for immediate shipment.

Any specific terms displayed on the applicable product page at the time of purchase will apply to that order.

13. Promotions, Discounts, and Coupons

Promotional codes, discounts, sales, giveaways, and other offers may be subject to additional terms.

Unless otherwise stated:

Promotions cannot be combined.
Promotions may have expiration dates.
Promotional offers may be limited to certain products or customers.
We reserve the right to modify or terminate promotions at any time.
Discounts may not be applied retroactively to previous purchases.

If a promotion is affected by an error, technical issue, or misuse, we reserve the right to correct or cancel the promotion.

You may opt out of marketing text messages at any time by replying STOP, CANCEL, or UNSUBSCRIBE to the applicable marketing message, or by contacting bill@diecastmanshop.com.

Message and data rates may apply. Message frequency may vary.

Opting out of marketing communications does not prevent us from sending necessary transactional or service-related communications, such as order confirmations, shipping updates, account notices, or other communications necessary to provide the Services.

16. Community Standards and User Content

We may provide features that allow users to submit reviews, comments, photographs, videos, feedback, or other content ("User Content").

By submitting User Content, you agree that:

You have the right to submit the content.

Your use of third-party services is at your own risk and may be subject to additional terms imposed by those providers.

20. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis.

We do not guarantee that:

The website will always be available or uninterrupted.
The website will be error-free.
Product information will always be completely accurate or current.
The Services will be free from viruses or other harmful components.
Products will meet every individual expectation or intended use.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded or limited under applicable law.

21. Limitation of Liability

22. Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Diecastman's Shop and its owners, employees, representatives, affiliates, and service providers from claims, damages, liabilities, losses, costs, and expenses arising out of:

Your unlawful use of the Services.
